Sherman Marek is the founder of Marek Health Law and a nationally recognized medical education (ME) lawyer and advocate with over 35 years of litigation experience. He has represented more than 1,000 medical students, residents, and fellows in complex disputes involving medical schools, hospitals, and professional organizations nationwide. His litigation experience includes antitrust, whistleblower (False Claims Act), and high-impact employment matters.
Mr. Marek led the landmark class action Jung v. AAMC, which challenged the structure of the National Resident Matching Program. Although the case was ultimately preempted by federal legislation, it catalyzed the adoption of national duty hour limits for medical residents—standards that remain in place today.
His practice is defined by bold, strategic advocacy on behalf of physicians-in-training and a deep commitment to holding institutions accountable. Marek Health Law was co-founded with a J.D./M.D./Ph.D. who had been effectively terminated by a residency program—a matter they litigated together in federal court over several years.
