The firm’s founder and principal attorney, Sherman Marek JD, has more than 35 years of experience in employment and complex commercial litigation matters in state and federal courts nationwide. He and his current team of full-time lawyers at Marek Health Law have represented more than 1,000 individual medical students, residents, and other physicians in disputes and other matters involving medical schools, teaching hospitals, licensing boards, certification boards, physician health programs, and others. Mr. Marek originated a landmark antitrust lawsuit against the NRMP and dozens of teaching hospitals, and led a team of more than 15 plaintiffs law firms in an effort to achieve higher wages and lower work hours for medical residents. That lawsuit precipitated the ACGME work hour limits, which remain in force today more than 20 years later.

Pre-Litigation Consulting, Negotiation, and Resolution

In hundreds of matters, Marek Health Law successfully consulted, negotiated, and obtained favorable results for our clients that eliminated unlawful discrimination and restored equality in the workplace; ended sexual harassment and resumed respect and professionalism; amended and corrected false or inaccurate performance evaluations; rescinded probation or remediation and reestablished good standing; reversed extensions of training and resumed normal completion schedules; lifted suspensions and achieved returns to work; resolved unwarranted fit-for-duty referrals; reversed unjustified terminations; renewed contracts after notices of non-renewal; corrected damaging verifications of training or employment; obtained verifications initially withheld; and/or recovered attorneys’ fees, money damages, expenses, or other funds for the benefit of our clients. Nonetheless, outcomes vary and depend on the specific and unique facts of each matter.

Litigation for Discrimination, Breaches of Contract, Defamation, Tortious Interference, Blacklisting, Violations of Due Process, and False Claims

Marek Health Law is prepared to litigate on behalf of medical students, residents, or other physicians if initial efforts fail to resolve matters cooperatively. The firm has served as primary counsel, co-counsel, consulting counsel, or referring counsel in many lawsuits, including cases filed in federal and/or state courts in New York, California, Florida, Ohio, Colorado, North Carolina, Missouri, Kentucky, and Louisiana. This list will continue to expand as the right opportunities arise. Additionally, we are prepared to engage in government agency proceedings on behalf of our clients. We have done so before various state and federal authorities, including but not limited to the Department of Justice (DOJ), Department of Health and Human Services (HHS), Department of Education (DOE), and Equal Employment Opportunity Commission (EEOC). In addition to other litigation successes, we have recovered tens of millions of dollars in bounties for our whistleblower clients by pursuing Medicare billing fraud claims under the federal False Claims Act and corresponding state laws.

Our attorneys are fully licensed to practice law in the States of Illinois, New York, Connecticut, and Missouri. We are not fully licensed to practice in other states. However, we are generally permitted to represent clients in other states under their respective “multi-jurisdictional practice” rules, which impose certain requirements to ensure competent representation.  Additionally, we often partner with local attorneys fully licensed in their state who are experienced and successful in employment matters generally but need our guidance, extensive experience, and expertise in this narrow and specific area of practice.

Class Action Litigation

We are also prepared to litigate class actions on behalf of those injured by systemic misconduct. For example, we originated and pursued a groundbreaking antitrust class action filed in 2002  in the District of Columbia federal court on behalf of tens of thousands of medical residents whose wages were depressed, and work hours inflated, by the annual Match and other restraints on free competition for residents among teaching hospitals. The filing of that lawsuit caused teaching hospitals to immediately and “voluntarily” adopt weekly work hour limits that had been refused for decades. Those limits continue to exist and protect residents even today.
